Judgment is expected to be delivered today in the High Court following hundreds of people receiving allegedly faulty hip replacements. Thought to be one of the largest product liability group actions heard in the UK, some 312 claimants are suing the manufacturer of the Pinnacle Ultamet hip joint, DePuy.
Lawyers claim that clients have suffered localised and systemic damage after tiny metal fragments and large volumes of toxic metal debris have been released from the implant into the blood stream. The court has also previously heard that after being in situ for 10 years, the hip joint had a failure rate of up to six times higher than alternative replacement materials. Accordingly, the implants were taken off the market in 2013.
More than 20,000 patients have been fitted with the Pinnacle Ultamet implant and in 2017, the Medicines and Healthcare products Regulatory Agency advised every patient who has had a metal-on-metal prosthetic to have regular check ups to try and spot any errors or issues. Approximately 56,000 UK patients have been fitted with a metal-on-metal hip device and it is hoped by the MHRA that patients will receive the best outcomes if any problems are identified early and treated if necessary.
DePuy have denied that it’s product was defective and have previously reported, “the device is backed by a strong record of clinical data showing reduced pain and restored mobility for patients. It also previously argued in court that the product met all relevant EU and UK standards in place at the time.
